Was the Berne Convention of Copyright signed by UAE?
Yes, United Arab Emirates joined the Berne Convention for the Protection of Literary and Artistic Works on July 14, 2004. The Berne Convention is an international agreement governing copyright, which was first accepted in Berne, Switzerland, in 1886. The Berne Convention formally mandated several aspects of modern copyright law; it introduced the concept that a copyright exists the moment a work is "fixed". It also enforces a requirement that countries recognize copyrights held by the citizens of all other signatory countries. The Berne Convention is administrated by World Intellectual Property Organization. The Berne Convention deals with a law enforcement and the protection of works and the rights of their authors. It provides rightsholders with the means to control how their works are used, by whom, and on what terms.
Will copyright certificate protect our proposed platform and Idea’s? For example, if someone changed minor design or adding new capabilities/features within the Website & application then how this is protected?
The problem of weak legal protection of IP work after minor changes is typical for the patents for inventions, because patent protects registered IP-rights only in case if unfair competitor is illegally using fully identical copies of registered by patent IP-work. Copyright registration (of work of science) provides legal protection for the whole creative concept of the work, expressed and implemented in any objective and evidentiary form. For example, if somebody will change the names or design of the main characters in Walt-Disney movie - is does not mean that Walt-Disney corporation can not ban illegal film-production and sales of similar branded products of an unfair competitor, because the court will consider the level of similarity of creative work, not only specific features and design. The same legal approach is applicable to all other types of copyright works, including works of science.
You are mentioning within the WOS the protection scope is [Way of using, Way of working, Structure, Design] this is good but what about the core idea & concept of the solution/platform?
According to paragraph 3 of the UAE Federal Law No. (7) of the Year 2002 Concerning Copyrights and Neighboring Rights: - 'Protection does not extend to mere ideas, procedures, methods of work, mathematical understandings, principles, and abstract facts'. This statement is absolutely correct because Copyright law protects the practical and evidentiary implementation of ideas, but not the abstract/oral ideas and facts themselves. Such legal position was established to provide the phrase “freedom of expression” as describing the First Amendment (to US Constitute, adopted in 1971) right and in international Berne Convention (as amended on September 28, 1979). For example - the idea to create software for car-for-hire service through smartphones is not protectable and could not be registered as a copyright work regardless of the form in which this idea will be described or explained. But practically implemented by UBER-company business model of car-for-hire service (in form of source code of factually created web-site and mobile applications, design of interface, detailed operational mechanism, etc.) is protected as an intellectual property (in form of the copyright works). Legal definition and such type of IP as 'work of science' is stipulated in UAE Federal Law No. (7) of the Year 2002 Concerning Copyrights and Neighboring Rights.
What we are gaining with signing the copyright globally if someone else copy the same idea and concept then what will be the legal process?
All IP-works registered in form of copyright items are protected in all countries - members of Berne Convention. This statement means that to start any litigation process against unfair competitor (violator), who is illegal using the protected IP-work, the rightsholder should prove one of the following signs:
1. Violator is located in the member-country of Berne Convention;
2. Violator (or his company) is citizen/resident (registered) in one of the member-countries of Berne Convention;
3. Place of violation is located in the member-country of Berne Convention; 4. The authorized by ICANN domain-registrar company (that provides domain registration services for violator) is located (registered) in one of the member-countries of Berne Convention;
5. The hosting-company (providing hosting services for violator) is located (registered) in the member-country of Berne Convention;
6. The violation (illegal using of similar IP-work) was in global online services like Google, Youtube, Facebook, Instagram, etc.
We have been asking about the possibility of protecting the concept, but all lawyers and IP-companies said it wasn’t possible. But what we really need the IP eventually. I wish if you have time to explain to us during this meeting how to protect the concept
The first problem of UAE lawyers and patent attorneys is lack of experience in protection of creative works according to the international standards. Last 30 years they have provided registration only for trademarks, inventions, industrial design, and the computer programs. Second problem - the procedure of registration of creative works is also not fully and clear regulated by local laws. These 2 problems are the main reasons - why local lawyers cannot correctly identify - through which form of IP could be registered such kind of work as a 'concept'. Local lawyers are considering 'concept' same as an 'idea'. And therefore apply to the 'idea' the regulation from paragraph 3 of the UAE Copyright law: - Protection does not extend to mere ideas, procedures, methods of work, mathematical understandings, principles, and abstract facts. At the same time - according to the Berne Convention of copyright (signed in 2004 by UAE), the IP-works could be registered as a 'work of science'. Definition and such type of IP as 'work of science' are also stipulated in UAE Copyright law, but in local laws, there are no any regulations - how to register the 'work of science'. Work of science - is a "creative expression" of an idea, which is describing the way of implementation of an idea, and according to the UAE Copyright law: - Protection does not extend to mere ideas, procedures, methods of work, mathematical understandings, principles, and abstract facts, but extend to creative expression in any of them. In UAE exists only one official representative office of the international registrar who can provide registration for Work of science - European registrar INTEROCO Copyright Office. And therefore we can provide you the service and register your business concept as a creative expression of the idea in the legal form of Works of science
